i have seen it. she described being on her hands and knees as leopold required her help to change a urine bag following back surgery. >> were you afraid you might get fired, it happened over and over again. >> reporter: during opening statements defense attorney focused on his health showing an x-ray of his back. it's a miracle that john leopold did not just sit down, and say i cap do this, marcus said. the state argued he wasted tax dollars by misusing security officers who are members of the arundel county police department. he is charged with four counts of misconduct in office and one count of fraud. the state called members of the arundel county police department and former county executive owens has it worked to proof he abused -- proof he abused his powers.

cheryl conner, abc2 news. >> the trial will pick up on tuesday because of the holiday monday. county executive could lose his job and face jail time as well. a police officer is the focus of an animal cruelty investigation. jeff hager is live with more on how the case was discovered. >> it's said a dog is man's best friend, but in this case, the allegations are true, the dog's owner was his first enemy. the call came in to arundel animal control december 22nd, when an officer responded to a report of a stray dog, they found nicholas, a shepherd mix, emaciated and bleeding from the lower quarters. he won over the hearts of the staff at the animal hospital. >> he was a very cool dog. he did tricks and would sit and give you his paw. he would show you he wanted

attention. he would do a dance with his paws if you were nears he would lean on you. >> reporter: nicholas' owners failed to provide nicholas n8gj the attention he needed the most, medical attention. now they find themselves on the wrong side of the law. >> the owner of the dog is a police officer, 11 year veteran, he is placed on administrative duty pending the outcome of the investigation. >> reporter: proving fatal for nicholas. the doctor neutered the dog and treated him for prostate and kidney infections. ultimately on monday, the veterinarian had to put him down. >> we have to take care of them, sometimes euthanizing is the only option. he was very sweet dog. we fell in love with him. completely. talking about him, our technicians cried because he was just so sweet. >> following the death, the

sitting on the bench waiting on the subway when a man tosses her on the tracks in philadelphia. he walked free for two days. police didn't release a p description until later. >> i wanted to catch this guy, i truly felt that the best way to do that was to hold onto the information about his jacket and put as many officers as i could out there, to catch him. it worked. >> the woman was able to pull herself up off of the tracks. they weren't sure of a motive but believe the man may have had mental illness. armed guard is robbed walking in to a bank. see the robbers made the guard lay flat on the grounds and grabbed the money and took off. the guard got up and shot at the robbers. fbi believes he hit the driver in the leg. undisclosed amount of cash was taken from the brinks driver.
